Welcome to Herald Photography LLC (“we,” “our,” or “us”). By accessing or using our website, online galleries, or photography services, you (“Client,” “you,” or “your”) agree to be bound by the following terms and conditions. Please read them carefully.
1. Acceptance of Terms
By using our website, viewing your gallery, or purchasing our products or services, you agree to comply with these Terms of Service, our Privacy Policy, and any written agreements provided to you. If you do not agree, you must not use our services.
2. Photography Services
All sessions, products, and services are subject to written agreement and payment terms provided at the time of booking.
Image delivery timelines are estimates and may vary based on workload, editing requirements, or unforeseen circumstances.
Unless otherwise agreed upon in writing, the Photographer retains full copyright to all images.
3. Online Gallery Access
Galleries may be password-protected. You are responsible for keeping your access credentials secure.
Galleries are available for a limited time, after which they may be archived or deleted. Expiration dates will be communicated in advance.
Sharing gallery links and passwords with others grants them access to view and/or download images — you accept responsibility for any such access.
4. Image Usage Rights
Personal-use licenses are included with most sessions. This allows you to download, print, and share images for personal, non-commercial purposes only.
Commercial use requires a separate written agreement and may incur additional fees.
Credit to Herald Photography LLC must be given when sharing images publicly unless otherwise agreed upon in writing.
5. Third-Party Services
We use third-party printing labs and gallery hosting platforms to deliver our services. While we select reputable providers, we are not responsible for variations in print quality, shipping delays, or technical issues beyond our control.
All print sales are final; defective or damaged products must be reported within the timeframe specified in our Terms of Sale.
6. Cancellations, Rescheduling, and Refunds
All cancellation, rescheduling, and refund policies are detailed in your service agreement or invoice.
Retainers or deposits are generally non-refundable unless otherwise stated.
7. Limitation of Liability
We are not liable for any damages, losses, or expenses arising from use of our services, products, or website, except where prohibited by law.
In the unlikely event that images are lost, damaged, or unavailable due to circumstances beyond our control, liability is limited to a refund of payments received for the affected portion of the service.
8. Conduct & Safety
We reserve the right to refuse service or end a session if we feel unsafe or are subjected to inappropriate behavior.
Clients are responsible for ensuring the safety and cooperation of any participants in the session.
9. Changes to These Terms
We may update these Terms of Service from time to time. The latest version will always be posted on our website with the “Effective Date” listed above.
